01Agreement
These Terms of Service ("Terms") govern your use of the Job Stream mobile application and related services (the "Service"), operated by Job Stream ("we", "us"). By creating an account or using the Service, you agree to these Terms. If you use the Service on behalf of a company (your "Organization"), you represent that you have authority to bind that Organization, and "you" includes it.
02What the Service is
Job Stream lets members of an Organization stream live video from job sites to the Organization's authorized viewers — such as management and site supervisors — and stores recordings of those streams for later review. The Service is a business tool intended for use on work sites the Organization controls or is authorized to record.
03Eligibility
You must be at least 18 years old (or the age of majority where you live) and able to form a binding contract to use the Service. The Service is not for personal, family, or household use.
04Accounts and Organizations
- You are responsible for your credentials and for activity under your account. Notify us promptly of any unauthorized use.
- Organization administrators control who in the Organization can stream, who can watch, and how recordings are managed. Access granted by an Organization can be revoked by that Organization.
- Information you provide must be accurate and kept up to date.
05Your content
Streams and recordings created through the Service belong to you and your Organization. You grant us a limited, worldwide, non-exclusive license to host, transmit, store, and process that content solely to operate, secure, and improve the Service. We do not publish your streams; they are visible only to viewers your Organization authorizes.
You are responsible for the content you stream. You represent that you have the rights and permissions needed to capture and share it.
06Acceptable use
You agree to use the Service only for lawful jobsite monitoring and documentation. You must not:
- Stream or record locations you are not authorized to record, or use the Service for surveillance unrelated to legitimate work purposes.
- Violate laws that apply to workplace recording, audio interception, notice, or consent in your jurisdiction. Your Organization is responsible for giving any legally required notice to people who may appear on camera.
- Record areas where people have a reasonable expectation of privacy (restrooms, changing areas, private residences without consent).
- Use the Service to harass, discriminate, or retaliate against workers, or to violate labor laws or collective agreements.
- Interfere with the Service, probe or breach its security, reverse engineer it, or access it by automated means without permission.
We may suspend or terminate access for violations of this section.
07Not a safety or emergency service
Job Stream is a viewing and documentation tool. It is not a safety-monitoring, alarm, or emergency-response system, and it must not be relied on to detect hazards, prevent accidents, or summon help. Streams can be delayed, interrupted, or unavailable. Maintain your normal site-safety procedures, supervision, and emergency channels as if Job Stream did not exist.
08Availability
We aim to keep the Service reliable, but we do not guarantee uninterrupted or error-free operation. Streaming quality depends on network conditions, devices, and other factors outside our control. We may modify, suspend, or discontinue features, and we may impose or change storage and retention limits with reasonable notice where practicable.
09Termination
You may stop using the Service at any time, and an Organization may close its account. We may suspend or terminate access if you breach these Terms, create risk for us or others, or if required by law. Upon termination, your right to use the Service ends; provisions that by their nature should survive (including content licenses needed to wind down, disclaimers, and liability limits) survive.
10Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT STREAMS OR RECORDINGS WILL BE COMPLETE, ACCURATE, CONTINUOUS, OR PRESERVED.
11Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO THE SERVICE. OUR TOTAL LIABILITY FOR ALL CLAIMS WILL NOT EXCEED THE GREATER OF THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM OR ONE HUNDRED US DOLLARS (US$100). Some jurisdictions do not allow the exclusion or limitation of certain damages, so parts of this section may not apply to you.
You and your Organization are responsible for compliance with employment, privacy, and recording laws in your use of the Service, and you will indemnify us against third-party claims arising from streams or recordings made through your account in violation of these Terms.
12Governing law and disputes
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws principles. The exclusive venue for disputes is the state or federal courts located in Delaware, and each party consents to the personal jurisdiction of those courts. Before filing a claim, contact us at support@hydroxapp.com — most disputes can be resolved informally.
13Changes to these Terms
We may update these Terms as the Service evolves. If we make material changes, we will update the date above and provide notice through the app or the site. Continued use after changes take effect means you accept the revised Terms. These Terms take effect when the Service publicly launches.
